<br />5. QUALIFICATION FOR, AND FILING OF, RELOCATION CLAIMS <br />To qualify for a Replacement Housing Payment, you must rent or purchase and occupy a comparable <br />replacement unit within one year from the date you move from the displacement dwelling. <br /> <br />All claims for relocation benefits must be filed with the new Owner within eighteen (18) months <br />from the date you vacate your current unit. <br /> <br />6. RENTAL AGREEMENT <br /> <br />As a result of the new Owner s purchase of the property where you live, you may become a tenant of <br />the new Owner. If this occurs, you will be asked to sign a rental agreement which will specify the <br />monthly rent to be paid, when rent payments are due, where they are to be paid and other pertinent <br />information. <br /> <br />7. EVICTIONS <br /> <br />Eviction for cause must conform to applicable State and local law. Any person who lawfully occupies <br />the real property on the date of initiation of negotiations, is presumed to be entitled to relocation <br />benefits, unless the new Owner determines that: <br />The person received an eviction notice prior to the initiation of negotiations and, as a result, <br />was later evicted; or <br />The person is evicted after the initiation of negotiations for serious or repeated violation of <br />material terms of the lease; and <br />The eviction was not undertaken for the purpose of evading relocation assistance regulations. <br /> <br />Eviction will be undertaken only in the event of one or more of the following reasons: <br />Failure to pay rent; except in those cases where the failure to pay is due to the lessor's failure <br />to keep the premises in habitable condition, is the result of harassment or retaliatory action or <br />is the result of discontinuation or substantial interruption of services; <br />Performance of dangerous illegal act in the unit; <br />Material breach of the rental agreement and failure to correct breach within the legally <br />prescribed notice period; <br />Maintenance of a nuisance and failure to abate within a reasonable time following notice; <br />Refusal to accept one of a reasonable number of offers of replacement dwellings; or <br />The eviction is required by State or local law and cannot be prevented by reasonable efforts <br />on the part of the public entity <br />Except for the causes of eviction stated above, no person lawfully occupying the unit to be purchased <br />by the new Owner will be required to move without having been provided with at least 90 days written <br />notice to vacate. <br /> <br />8. APPEAL PROCEDURES - GRIEVANCE <br /> <br />Any person who disagrees with a determination of eligibility for, or the amount of, a payment under <br />the Relocation Assistance Program may appeal the determination and have the appeal application <br />reviewed by the new Owner in accordance with their appeals procedure. Complete details on appeal <br />procedures are available upon request from the new Owner. <br /> <br />9.
