8x7 <br />Units that are half full or less will receive half of the total payment; or <br /> <br />B. A payment for your Actual Reasonable Moving and Related Expenses based on at least two written <br />estimates and receipted bills; or <br />C. A combination of both (in some cases). <br /> <br />3. QUALIFICATION FOR, AND FILING OF, RELOCATION CLAIMS <br /> <br />All claims for relocation benefits must be filed with the new Owner within eighteen (18) months <br />from the date on which you vacated the storage unit. <br /> <br />4. RENTAL AGREEMENT <br /> <br />As a result of the new Owner s action to purchase the property where you currently rent storage space, <br />you may become a storage tenant of the new Owner. If this occurs, you will be asked to sign a rental <br />agreement which will specify the monthly rent to be paid, when rent payments are due, where they <br />are to be paid and other pertinent information. <br /> <br />5. EVICTIONS <br /> <br />Eviction for cause must conform to applicable State and local law. Any person who lawfully rents <br />storage space on the date of initiation of negotiations, is presumed to be entitled to relocation benefits, <br />unless the new Owner determines that: <br />a. The person received an eviction notice prior to the initiation of negotiations and, as a result, <br />was later evicted; or <br />b. The person is evicted after the initiation of negotiations for serious or repeated violation of <br />material terms of the lease; and <br />c. The eviction was not undertaken for the purpose of evading relocation assistance regulations. <br /> <br />Eviction will be undertaken only in the event of one or more of the following reasons: <br />d. Failure to pay rent; except in those cases where the failure to pay is due to the lessor's failure <br />to keep the premises in habitable condition, is the result of harassment or retaliatory action or <br />is the result of discontinuation or substantial interruption of services; <br />e. Performance of dangerous illegal act in the storage unit or at the Site; <br />f. Material breach of the rental agreement and failure to correct breach within the legally <br />prescribed notice period; <br />g. Maintenance of a nuisance and failure to abate within a reasonable time following notice; <br />h. The eviction is required by State or local law and cannot be prevented by reasonable efforts <br />on the part of the public entity <br />Except for the causes of eviction stated above, no person lawfully renting a storage space to be <br />purchased by the new Owner will be required to move without having been provided with at least 90 <br />days written notice from the Displacing Agency. <br /> <br />6. APPEAL PROCEDURES - GRIEVANCE <br /> <br />Any person who disagrees with a determination of eligibility for, or the amount of, a payment under <br />the Relocation Assistance Program may have the appeal application reviewed by the new Owner in <br />accordance with their appeals procedure.
