The Grantee covenants and agrees, for itself and its successors and assigns, that <br />there shall be no discrimination against or segregation of any person or group of persons on account <br />of race, color, creed, religion, sex, sexual orientation, age, marital status, national origin, or <br />ancestry in the sale, lease, sublease, transfer, use, occupancy, tenure or enjoyment of the Property, <br />nor shall the Grantee itself or any person claiming under or through it establish or permit any such <br />practice or practices of discrimination or segregation with reference to the selection, location, <br />number, use or occupancy of tenants, lessees, subtenants, sublessees or vendees in the Property <br />and the Improvements thereon. <br /> <br />4. The Grantee hereby agrees and acknowledges that, as of the date of recordation of <br />this Grant Deed, the Property is subject to that certain “Irrevocable Offer to Dedicate”, to be <br />recorded concurrently herewith, under which Grantee is required to irrevocably offer for <br />dedication the Property to the City or to a City Qualified Designee upon certain terms and <br />conditions set forth in the recorded Irrevocable Offer to Dedicate The Grantee and Grantor further <br />acknowledges that such Irrevocable Offer is a separate instrument and at any time the Irrevocable <br />Offer to Dedicate has terminated in accordance with its terms, the Property shall no longer be <br />subject to the provisions of the Irrevocable Offer to Dedicate, without affecting the validity or <br />continued effect of this Grant Deed. <br /> <br />5.
