Page 10 of 16 <br />Section 12955 and Section 12955.2 of the Government Code, in the sale, lease, sublease, transfer, <br />use, occupancy, tenure or enjoyment of the Property herein conveyed, nor shall the grantee or any <br />person claiming under or through the grantee, establish or permit any practice or practices of <br />discrimination or segregation with reference to the selection, location, number, use or occupancy <br />of tenants, lessees, subtenants, sublessees or vendees in the property herein conveyed. The <br />foregoing covenant shall run with the land. <br /> <br />Section 3.6 Amendments. This Deed of Trust cannot be waived, changed, discharged <br />or terminated orally, but only by an instrument in writing signed by Beneficiary and Trustor. <br /> <br />Section 3.7 Reconveyance by Trustee. Upon written request of Beneficiary stating that <br />all Secured Obligations under the City Documents have been performed, and upon surrender of <br />this Deed of Trust to Trustee for cancellation and retention, and upon payment by Trustor of <br />Trustee's reasonable fees, Trustee shall fully reconvey the Security to Trustor, or to the person or <br />persons legally entitled thereto. <br /> <br />Section 3.8 Notices. <br />(a) If at any time after the execution of this Deed of Trust it becomes necessary or <br />convenient for one of the parties hereto to serve any notice, demand or communication upon the <br />other party, such notice, demand or communication must be in writing and is to be served <br />personally, by reputable overnight delivery service (which provides a delivery receipt) or by <br />depositing the same in the registered United States mail, return receipt requested, postage prepaid <br />and, (1) if intended for Beneficiary is to be addressed to: <br /> City: <br />City of Redwood City <br /> 1017 Middlefield Road <br /> Redwood City, CA 94063 <br /> Attention: City Manager <br /> <br /> with copy to: <br /> <br />City of Redwood City <br />Office of the City Attorney <br /> 1017 Middlefield Road <br /> Redwood City, CA 94063 <br /> Attention: City Attorney <br /> <br /> and (2) if intended for Trustor shall be addressed to: <br /> <br />__________________________ <br />__________________________ <br />[City], [State], [Zip] <br />Attention: __________________ <br /> <br /> <br />ATTY/RESO.0024/PC RESO 901 EL CAMINO <br />REV: 04-11-25 VR
