ATTY/RESO.0090/PC RESO 1201 MAIN STREET MIXED USE PROJECT <br />REV: 08-15-25 VR <br />Page 2 of 32 <br />WHEREAS, State Density Bonus Law (Government Code 65915 Sections et. seq.) <br />incentivizes the construction of affordable housing by allowing a developer to add <br />additional housing units to a project beyond the zoned capacity and secure other <br />incentives in exchange for a commitment to include deed-restricted affordable units. A <br />developer is entitled to: (a) a specified number of modifications to development <br />regulations that would result in identifiable and actual costs reductions needed to provide <br />affordable housing, known as concessions, and (b) an unlimited number of modifications <br />to development regulations that are needed to physically accommodate the proposed <br />project, known as waivers. If a housing development project is entitled to a density bonus, <br />concessions, and/or waivers, those modifications of local rules cannot be considered a <br />violation of a general plan, zone code, or other local regulation or a basis for denying a <br />project. The City has adopted Redwood City Municipal Code Section 32.19, which <br />implements the Density Bonus law (“Density Bonus Ordinance”); and <br /> <br />WHEREAS, per State Density Bonus Law (Government Code Section <br />65915(f)(1)), the Project is eligible for up to a 21.5% density bonus because the project <br />is providing 11% lower income units on-site and has requested a 21.5% density bonus; <br />and <br /> <br />WHEREAS, per State Density Bonus Law (Government Code Section <br />65915(d)(2)(A) and (e)(1)), the Project is entitled to one concession and unlimited <br />waivers, and the Applicant is requesting to apply one concession to increase building <br />Floor Area Ratio (FAR) and three waivers for the pervious area requirement, the 45- <br />degree daylight plane requirement, and compact parking spaces for 15% of the total <br />spaces; and <br /> <br />WHEREAS, the City’s Density Bonus Ordinance (Section 32.19(F)(3)) presumes <br />building FAR result in identifiable and actual cost reductions to provide for affordable <br />housing costs; and <br /> <br />WHEREAS, on June 5, 2025, the Architectural Advisory Committee (AAC) of the <br />City of Redwood City conducted a public hearing to consider the proposed project and <br />voted 4-0 to recommend that the City’s Planning Commission (“Planning Commission”) <br />approve the Project; and <br /> <br />WHEREAS, the Planning Commission is empowered by the Redwood City <br />Municipal Code make decisions subject to Planning Commission review, including to act <br />upon applications for Architectural Permits, Tentative Parcel Maps, and Use Permits; and <br /> <br />WHEREAS, on August 8, 2025, a public hearing notice was published in the San <br />Mateo Daily Journal and mailed to interested parties and all property owners within 300 <br />feet of the property; and <br /> <br />WHEREAS, on August 19, 2025, the Planning Commission conducted a duly <br />noticed public hearing in accordance with all applicable requirements of the State
