Assembly Bill 340, the Public Employees’ Pension Reform Act of <br />2013 added Government Code Section 7522.56, which generally <br />prohibits the employment of a CalPERS retiree by a public <br />employer for a period of 180 days following retirement. <br />Government Code Section 7522.56(f)(1) provides a limited <br />exception to this 180-day waiting period when the employer <br />certifies that the appointment of the retiree is necessary to fill a <br />critically needed position. <br />City has 2.0 FTE (full-time equivalent) Deputy Chief positions: <br /> 1.0 FTE filled on January 20, 2026 <br /> 1.0 FTE on an extended leave of absence <br />5 of 7 <br />BACKGROUND
