KREAGER, TRUSTEES OF THE PROJECT PARCEL NO. 64075 <br />REVOCABLE LIVING TRUST AGREEMENT OF JEFF A. KREAGER AND LORETTA V. KREAGER <br />DATED OCTOBER 9,1989 <br />PROJECT: US HIGHWAY 101 /STATE ROUTE 84 (WOODSIDE ROAD) INTERCHANGE IMPROVEMENT PROJECT <br />access and parking <br />The term of the TCE shall be thirty-six (36) months effective with notice of commencement of <br />physical possession given In writing by GRANTEE to GRANTOR prior to commencement. <br />unless extended pursuant to agreement by GRANTOR and GRANTEE. Said 36 -month penod <br />shall terminate upon project construction completion of June 36, 2029, whichever is earlier <br />GRANTOR warrants that It is the owner to fee simple of the real property affected by the TGE as <br />described in Exhibit "A" attached hereto. <br />Upon termination of the TCE. GRANTEE shall restore, as near as possible, the TCE surface <br />area to the condition in which it was prior to the commencement of the TCE_ GRANTEE further <br />agrees to pay for damage to the property caused by GRANTEE, its agents or contractors_ <br />GRANTEE agrees to indemnify GRANTOR against all damages, expenses, costs. and charges, <br />and to save GRANTOR harmless front any and all claims for damages arising from and related <br />to use of the TCE by GRANTEE, Its agents or contractors. This instrument contains the entire <br />agreement between the parties relating to the rights herein granted and the obligations herein <br />assumed. Any oral representations or modifications covering this Instrument shall be of no <br />force and effect excepting a subsequent modification in writing signed I>y the parties. <br />The provisions hereof shall inure to the benefit of and bind the successors and assigns of the <br />respective parties <br />IN WITNESS WHEREOF, GRANTOR has caused this Grant of Temporary Construction <br />Easement to be executed as of this day of 202_ <br />SIGNED. <br />TODD L.
