KREAGER <br />DATED OCTOBER 9, 1989 <br />PROJECT: US HIGHWAY 1011 STATE ROUTE 84 (WOODSIDE ROAD) INTERCHANGE IMPROVEMENT PROJECT <br />EXHIBIT "3" <br />Parcel No. 64075 <br />Kreager Family Taut <br />Tenant -Custom Truk <br />Tenant's Waiver and Ac knovdedgement of Constrii(tion Impacts <br />This Waiver and Acknowledgement ("the Waiver") has been signed <br />2025, by Cli3TQM TRUCK ("the Tenant") who acknowledges and agrees that there will be <br />construction impacts on the property located at 1485 Veterans Blvd, Redwood City, CA 94063 <br />as shown on the attached Exhibit "A" as result of the City of Redwood City's US Highway 101 (US <br />101)/5tate Route (SR) 84 (Woodside Road) Int erthaoge improvement Proje(t (Project) and related <br />activities incidental to construction of the Project and construction within the Temporary <br />Construction Easement (TCE), which Is described in Exhibit "B" attached hereto and incorporated <br />herein by this reference, acquired by the City, <br />Said construction activities may impact certain site improvements within the TCE and may cause <br />temporary disruption to the Tenant. Written notification will be provided prior to the start of <br />the construction activities, and if there is any disruption to the Tenant's use of the Property, <br />the Contractor will provide notification prior to disruption of the Tenant. <br />Upon completion of the construction activities, any impacted site improvements will be replaced <br />and restored to the property's original condition, as necessary. <br />The overall project is projected to have a three (3) -year construction period, with a thirty-six <br />(36) month TCE term ending lune 30, 2029, or sooner dependent on the completion of <br />construction. However, the TCE will not restrict the use of the subject larger parcel, including <br />access and parking. <br />The Tenant understands and confirms that it will discharge and release the City, the State of <br />California and its contractors from disruptions that may occur because of the construction of the <br />Project and construction activities within the TCE and as permitted by the terms of the TCE. <br />The Tenant hereby waives all claims for any compensation against the City, the State of <br />California and its contractors arising out of or relating to the temporary loss of use of the TCE <br />area or disruptions to the Tenant so long as the disruptions are permitted by the TCE.
