FREEMAN AND JUDY A. FREEMAN, TRUSTEES OF THE FREEMAN FAMILY TRUST, AND JEFF A. KREAGER AND LORETTA V. KREAGER, TRUSTEES OF THE REVOCABLE LIVING TRUST AGREEMENT OF JEFF A. KREAGER AND LORETTA V. KREAGER DATED OCTOBER 9, 1989 (collectively "GRANTOR") hereby grants to THE CITY OF REDWOOD CITY, A CHARTER CITY AND A MUNICIPAL CORPORATION OF THE STATE OF CALIFORNIA (hereafter "GRANTEE"), a Temporary Construction Easement (hereafter "TCE") in and to a portion of its real property located in the County of San Mateo, State of California as described in Exhibit "A" attached hereto and incorporated herein by this reference. Said TCE is granted to GRANTEE, its successors and assigns, to have and to hold for purposes of GRANTEE's US Highway 101/State Route 84 (Woodside Road) Interchange Improvement Project (hereafter the "Project"). GRANTOR grants to GRANTEE a TCE in, over and to the area described Exhibit "A' for construction activities, including but not limited to, all purposes connected with the laying down, construction, rehabilitation and installation of the Project, and temporary staging together with the right of ingress and egress to and from the TCE area, for the purposes aforesaid. The Project is expected to have a thirty-six (36) month construction period. However, the use of the TCE on the subject parcel will not exceed ninety (90) days. GRANTEE will provide GRANTOR ten (10) days written notice prior to the commencement of its use of the TCE. During this ninety (90) day period access over and parking on the TCE area will be impacted. However, vehicular and pedestrian ingress and egress to and from the property via the existing driveway from Veterans Boulevard will always remain open during the 36 -month term of the TCE. Continued ingress and egress will be maintained by reconstructing the driveway in two phases leaving half the width of the driveway open for ingress and egress and when construction is completed on phase one, construct the phase two remaining half width driveway keeping the reconstructed driveway open for ingress and egress. Outside of this ninety (90) day period of use of the TCE, use of the TCE area by GRANTOR will not be impacted, including REV: 11-10-25 LR ATTY/AGR.2025.3021TODD L. AND JUDY A. FREEMAN, and JEFF A.
