Off -Site Wall <br />B21- <br />Wall along Hwy 101 <br />RWC Building Dept <br />5 -Feb -26 <br />15 -Apr -27 <br />Permit <br />2896 <br />10. Amendment of Section 6.1 (Developer Fees). A new Subsection 6.1.A.(3) is added <br />to the Development Agreement as follows: <br />"(3) Notwithstanding anything to the contrary in this Section 6. 1, subject to <br />Developer meeting the Expedited Blomquist Construction Criteria (defined below), <br />Developer shall pay the impact fees in the column named "Proposed (parks escalated, TIF <br />& 101/84 credited)" In Table 6.1 below ("Alternative Fees") which account for additional <br />TIF and 101/84 credits for work performed (estimated savings of $2,044,133.60). The <br />"Expedited Blomquist Construction Criteria" means and includes all of the following: <br />(a) Developer has commenced construction of the Blomquist Extension Work within 18 <br />months following the Fourth Amendment Effective Date (the "Construction <br />Commencement Date" shall be memorialized by the Parties); and (b) after the <br />Construction Commencement Date, Developer has diligently prosecuted, and continues to <br />diligently prosecute construction of, the Blomquist Extension Work to completion such <br />that (i) the underground utilities component of such work (other than stormwater treatment <br />facilities), the retaining wall along the Caltrans right-of-way, and placement of fill to rough <br />grading elevations within the roadway and former LifeMoves site are on schedule to be <br />completed within 18 months following the Construction Commencement Date, as <br />reasonably determined by the City Manager or their designee, and (ii) all additional <br />components of the Blomquist Extension Work, including roadway curb, gutter, pavement; <br />sidewalks/multi-use path along roadway frontage; street trees; street lights; and stormwater <br />treatment improvements, are on schedule to be completed within 24 months following the <br />Construction Commencement Date, as reasonably determined by the City Manager or their <br />designee. If, after initially meeting the Expedited Blomquist Construction Criteria and <br />paying Alternative Fees for one or more residential units, Developer falls out of compliance <br />with the Expedited Blomquist Construction Criteria as reasonably determined by the City <br />Manager or their designee, then Developer shall immediately commence paying the <br />Existing Impact Fees, including all escalations thereof, required under Section 6.1.A.(1)- <br />(2) above, for all remaining residential units and Developer shall also pay City the total <br />difference between the Existing Impact Fees (including escalations) and the Alternative <br />Fees for all units Alternate Fees were paid for based on amounts in effect on the date the <br />Alternative Fees were paid (the "True Up Payment") within 45 days after City's demand <br />therefor." <br />(Remainder of page intentionally left blank) <br />ATTY/AGR/2025/AMEND.NO.4 - 1548 MAPLE DA <br />REV: 01-22-26 VR <br />Page 9 of 12 <br />
