(h) Costs of proper disposal of "your products", or products that contain "your products", that cannot be reused, not exceeding your purchase price of your cost to produce the products; 10. Newly Acquired Or Formed Organization Section II. C. Who Is An Insured is amended to include the following: Any organization you newly acquire or form, other than a partnership, joint venture, or limited liability company, and over which you maintain ownership or majority interest, will qualify as an Insured if there is no other similar insurance available to that organization. However: a. Coverage under this provision is afforded only until the 90th day from the date you acquire or form the organization or the end of the policy period, whichever is earlier; b. Paragraph A.1. Business Liability does not apply to: (1) "Bodily injury" or "property damage" that occurred before you acquired or formed the organization; and (2) "Personal and advertising injury" arising out of an offense committed before you acquired or formed the organization. No person or organization is an insured with respect to the conduct of any current or past partnership, joint venture, or limited liability company that is not shown as a Named Insured in the Declarations. 11. Additional Insureds When Required By Written Contract, Written Agreement Or Permit Section II. C. Who Is An Insured is amended to include the following: A person or organization qualifying as an insured under one of the Paragraphs a. through j. below, is added as an insured, subject to the terms in the paragraph under which they qualify, but only if you have agreed in a written contract or a written agreement or because of a permit issued by a state or political subdivision, that such person or organization is to be added as an additional insured on your policy. However, coverage for the additional insured applies only if the contract, agreement, or permit was executed prior to and in effect when the "bodily injury", "property damage" or "personal and advertising injury" was sustained. A person or organization is an additional insured under this provision only for that period of time required by the contract, agreement or permit. However, no such person(s) or organization(s) are additional insured(s) under this provision if such person(s) or organization(s) are included as an additional insured on a separate endorsement issued by us and made a part of this policy. a. Additional Insured - Controlling Interest Any person(s) or organization(s), but only with respect to their liability arising out of: (1) Their financial control of you; or (2) Premises they own, maintain or control while you lease or occupy these premises. This insurance does not apply to structural alterations, new construction and demolition operations performed by or for that person or organization. b. Additional Insured - Co -Owner Of Insured Premises Any person(s) or organization(s), but only with respect to their liability as co-owner of the premises shown in the Declarations. c. Additional Insured - Designated Person Or Organization Any person(s) or organization(s), but only with respect to liability for "bodily injury", "property damage" or "personal and advertising injury" caused, in whole or in part, by your acts or omissions or the acts or omissions of those acting on your behalf in the performance of your ongoing operations or in connection with your premises owned by or rented to you. d. Additional Insured - Grantor Of Franchise Any person(s) or organization(s), but only with respect to their liability as grantor of a franchise to you. e.
