A plat of of Laurel Way, showing improved/unimproved lots fronting <br />thereon, is attached hereto, marked Exhibit "A," and by this reference <br />incorporated herein. Appellant's Property is denoted thereon by shading, and <br />designated "Subject Pamel." References herein to street numbers correspond to <br />the lots so numbered on Exhibit A. <br /> 11. In 1971, assessment district proceedings were instituted for the <br /> improvement of Laurel Way. Those proceeding were terminated upon <br /> opposition to the formation of the district by some of the landowners. <br /> 12. In 1982, upon application of the owner, variances were granted to <br /> permit construction of a residence at 3733 Laurel Way, subject to the condition <br /> that the owner enter into an agreement with the City for the construction of the <br /> above-described one-half standard street width portion extending across the <br /> frontage of that lot and for construction of extensions of the water and sewer <br /> mains to serve said property. <br /> 13. In 1986, variances were granted to permit construction of a residence <br /> at 3737 Laurel Way, likewise upon the condition that the property owner enter <br /> into an agreement to improve Laurel Way to a width of one-half standard hillside <br /> street specifications across the frontage of said property and to extend the water <br /> and sewer mains to serve said property. <br /> 14. Concurrently with the application to improve the property located at <br /> 3737 Laurel Way, the then owner of 3741 Laurel Way sought similar entitlements <br /> which, if granted, would have provided variances to permit construction of a <br /> residence on that property, subject to conditions similar to that pertaining to 3737 <br /> Laurel Way. The City Council denied that request. The 3741 Laurel Way <br /> property is located across from the Property on the easterly side of the roadway. <br /> 15. In 1988, as a result of then pending applications for further <br /> development of properties fronting on Laurel Way, a report was submitted to the <br /> City Council providing information regarding the apparent demand for <br /> development and concerns of City Staff regarding development without adequate <br /> study (Report to Honorable Mayor and City Council from City Manager, dated <br /> September 1, 1988, Subject: Extension of Development on Laurel Way). On <br /> September 12, 1988, by consensus, the City Council concluded that soils and <br /> geologic conditions regarding further development on Laurel Way require that an <br /> Environmental Impact Report ("EIR") must first be prepared, in order to <br /> determine the environmental effect of development of the remaining <br /> undeveloped parcels of property on LaUrel Way so that cumulative impacts of <br /> development would be assessed in accordance with the California Environmental <br /> Quality Act (Pub. Resoumes Code 21000, et seq., "CEQA"). <br /> <br /> <br />
