Bradford Whitaker - -
Zoning Administrator
Page 7

improvements must be designed, configured, and constructed of such materials
as to serve overall development along Laurel Way.

34. An EIR:
· . . is an information document which will inform public
agency decision makers and the public generally of the significant
environmental effect of a project, identify possible ways to minimize
the significant effects, and describe reasonable alternatives to the
project..." (14 CCR §15121 (a)).
35. The initial review of a project under CEQA may be dispensed with if a
public agency can determine that an EIR will clearty be required for a project (14
CCR § 15060(c)).
36. The above-described known conditions affecting properties fronting
on Laurel Way, including the Property, provide sufficient information to dispense
with the initial review under CEQA regarding the necessity for the preparation of
an EIR. Said conditions require that an EIR be prepared before any further
developments on Laurel Way take place.
37. An EIR must, under CEQA, consider the cumulative effects of any
development project such as that proposed by Appellant. Said cumulative
effects must be analyzed in the context of the probability of future development
along Laurel Way.
38. The policy established by the City Council in 1988 regarding the
requirement for an EIR is based upon the foregoing rationale and, therefore,
should be affirmed.
39. In furtherance of the foregoing, Appellant's proposed Project, and any
entitlements pertaining thereto including, but not limited to, the granting of
variances, should not be approved until an EIR has been prepared which
adequately addresses the environmental impacts and, particularly, the
cumulative effects, of any such development.
40. Studies of geologic conditions only on the Property do not address
the cumulative effects of the Project.
41. Appellant's proposal to join with some other property owners to
improve Laurel Way to a 29 foot width and to construct corresponding extensions
of water and sewer lines does not take into consideration the effect thereof upon
further development of lots on Laurel Way, specifically with respect to alignment,
