An EIR: <br /> · . . is an information document which will inform public <br /> agency decision makers and the public generally of the significant <br /> environmental effect of a project, identify possible ways to minimize <br /> the significant effects, and describe reasonable alternatives to the <br /> project..." (14 CCR §15121 (a)). <br /> 35. The initial review of a project under CEQA may be dispensed with if a <br /> public agency can determine that an EIR will clearty be required for a project (14 <br /> CCR § 15060(c)). <br /> 36. The above-described known conditions affecting properties fronting <br /> on Laurel Way, including the Property, provide sufficient information to dispense <br /> with the initial review under CEQA regarding the necessity for the preparation of <br /> an EIR. Said conditions require that an EIR be prepared before any further <br /> developments on Laurel Way take place. <br /> 37. An EIR must, under CEQA, consider the cumulative effects of any <br /> development project such as that proposed by Appellant. Said cumulative <br /> effects must be analyzed in the context of the probability of future development <br /> along Laurel Way. <br /> 38. The policy established by the City Council in 1988 regarding the <br /> requirement for an EIR is based upon the foregoing rationale and, therefore, <br /> should be affirmed. <br /> 39. In furtherance of the foregoing, Appellant's proposed Project, and any <br /> entitlements pertaining thereto including, but not limited to, the granting of <br /> variances, should not be approved until an EIR has been prepared which <br /> adequately addresses the environmental impacts and, particularly, the <br /> cumulative effects, of any such development. <br /> 40. Studies of geologic conditions only on the Property do not address <br /> the cumulative effects of the Project. <br /> 41. Appellant's proposal to join with some other property owners to <br /> improve Laurel Way to a 29 foot width and to construct corresponding extensions <br /> of water and sewer lines does not take into consideration the effect thereof upon <br /> further development of lots on Laurel Way, specifically with respect to alignment, <br /> <br /> <br />
