City and HCD staff mutually agreed that the City does not need to implement a rezoning at this time to effectuate this program because the City has surplus capacity beyond its RHNA obigation even when excluding the few sites that are subject to Government Code section 65583.2(i). However, the City took the following actions in that support the intent of and further the goals of AB 1397:1. Send letters to each of the property owners of sites subject to Government Code section 65583.2(i) notifying them of their ability to pursue housing development projects with a streamlined review process if they meet 20% affordability levels pursuant to AB 1397;2. Flag subject properties on the City’s public-facing GIS portal to indicate eligibility for a streamlined review process pursuant to AB 1397; and3.
