will be required to provide your relocation agent with monthly rent and household income <br />verification prior to the determination of your eligibility for this payment. <br />Welm <br />B. Down -payment Assistance. If you qualify and wish to purchase a home as a replacement <br />dwelling, you can apply up to the total amount of your rental assistance payment towards <br />the down -payment and non-recurring incidental expenses. Your relocation agent will <br />clarify procedures necessary to apply for this payment. <br />5. QUALIFICATION FOR AND FILING OF, RELOCATION CLAIMS <br />To qualify for a Replacement Housing Payment, you must rent or purchase and occupy a <br />comparable replacement unit within one year from the date you move from the displacement <br />dwelling. <br />All claims for relocation benefits must be filed with the new Owner within eighteen (18) months <br />from the date you vacate your current unit. <br />6. RENTAL AGREEMENT <br />As a result of the new Owner's purchase of the property where you live, you may become a tenant <br />of the new Owner. If this occurs, you will be asked to sign a rental agreement which will specify <br />the monthly rent to be paid, when rent payments are due, where they are to be paid and other <br />pertinent information. <br />7. EVICTIONS <br />Eviction for cause must conform to applicable State and local law. Any person who lawfully <br />occupies the real property on the date of initiation of negotiations, is presumed to be entitled to <br />relocation benefits, unless the new Owner determines that: <br />• The person received an eviction notice prior to the initiation of negotiations and, as a result, <br />was later evicted; or <br />• The person is evicted after the initiation of negotiations for serious or repeated violation of <br />material terms of the lease; and <br />• The eviction was not undertaken for the purpose of evading relocation assistance <br />regulations. <br />Eviction will be undertaken only in the event of one or more of the following reasons: <br />• Failure to pay rent; except in those cases where the failure to pay is due to the lessor's <br />failure to keep the premises in habitable condition, is the result of harassment or retaliatory <br />action or is the result of discontinuation or substantial interruption of services; <br />• Performance of dangerous illegal act in the unit; <br />ATTY/AGR/2025.084/920 SHASTA AFFORDABLE HOUSING LAND DONATION AGREEMENT <br />REV: 10-16-25 VR <br />Exhibit B-2 - 30 <br />
