(8) Specific procedures for obtaining documentation regarding <br />prospective tenants' incomes, as necessary, to certify that such income does not exceed income <br />limits; <br />(9) Specific procedures for certification and recertification of household <br />incomes and procedures for handling over -income Residents; <br />(10) A requirement that a written rental agreement be executed with each <br />eligible household selected to occupy an Affordable Unit; <br />(11) A detailed listing of reasonable rules of conduct and occupancy <br />which shall be in writing, shall be consistent with federal and state law, and shall be provided to <br />each Resident upon occupancy; <br />(12) A parking management plan which details, among other things, how <br />parking spaces will be assigned, how guest parking will be handled and how parking will be <br />managed to encourage Residents to use their assigned parking spaces; <br />(13) Procedures for maintenance and management of the Affordable <br />Development; <br />(14) Procedures for dealing with Resident and neighborhood issues or <br />concerns; and <br />(15) Such other requirements and criteria/procedures as the City may <br />determine appropriate. <br />Section 5.2 Management Agent; Periodic Reports. <br />(a) The Affordable Units shall at all times be managed by an experienced <br />management agent, with demonstrated ability to operate residential facilities like the Affordable <br />Development in a high quality, decent, safe, and sanitary manner. The Affordable Developer shall <br />for the entire Term of this Agreement ensure that the management agent of the Affordable <br />Development has demonstrated experience and ability in operating and managing similar mixed - <br />income housing projects in the State of California and not less than two (2) years' experience with <br />resident income certification procedures outlined in Article 3 or similar experience ("Management <br />Agent"). Notwithstanding anything to the contrary herein, if the management agent does not meet <br />the qualifications specified above or the City and Affordable Developer agree that the management <br />of the Affordable Units must be transferred to another entity pursuant to Section 5.4(a) below, then <br />the Affordable Developer shall contract with a new management agent or subcontract with a <br />management agent that: (a) is a California entity whose primary business purpose is the <br />constriction, operation and management of affordable multifamily housing, or an affiliate thereof; <br />has not less than two (2) years' experience in owning, operating and managing affordable housing <br />projects in the eleven cormty San Francisco bay area; and (c) the proposed management agent has <br />no record of repeated defaults, material maintenance problems, housing or building code <br />violations, or substantiated fair housing complaints at properties it owns or operates.
