ATTY/RESO.0010/CC RESO AFFIRMING AUTHORITY OVER CITY FACILITIES <br />REV: 03-30-26 VR <br />Page 1 of 2 <br />RESOLUTION NO.16395 <br />A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF REDWOOD <br />CITY AFFIRMING THE CITY’S AUTHORITY TO REGULATE AND <br />CONTROL THE USE OF CITY PROPERTY AND FACILITIES <br />WHEREAS, the City of Redwood City is a municipal corporation organized under <br />the laws of the State of California and is vested with the authority and responsibility to <br />govern municipal affairs and protect the health, safety, and welfare of the community; and <br />WHEREAS, California Government Code Sections 37350 and 37351 authorize <br />cities to purchase, lease, receive, hold, and enjoy real and personal property and to <br />control and dispose of such property for the common benefit of the City and its residents; <br />and <br />WHEREAS, the City of Redwood City owns, leases, operates, and maintains <br />numerous public properties and facilities to support municipal operations and provide <br />services to the community; and <br />WHEREAS, City property and facilities include publicly owned buildings, parks, <br />parking lots and garages, and any other real property owned by the City of Redwood City; <br />and <br />WHEREAS, the orderly operation of municipal government and the conduct of <br />public business require that the City maintain clear authority over access to and use of <br />City property and facilities; and <br />WHEREAS, any use of City property or facilities must be expressly authorized by <br />applicable law, ordinance, resolution of the City Council, and/or a valid contract or permit <br />issued by the City; and <br />WHEREAS, any use of City property or facilities that has not been expressly <br />authorized by the City is prohibited; and <br />WHEREAS, the City of Redwood City maintains certain facilities and areas of <br />facilities that are restricted to City employees, officials, and individuals who have been <br />expressly authorized by the City to enter those locations; and <br />WHEREAS, unauthorized access to or use of City property or restricted areas of <br />City facilities may disrupt municipal operations and create operational safety and security <br />concerns; and <br />WHEREAS, the City Council of the City of Redwood City finds that maintaining <br />control over City property and facilities is essential to the orderly operation of municipal <br />government and to protecting the interests of the residents of Redwood City.
