<br /> PART I, Page | 6 <br />Eligibility to Apply <br />Applicants eligible to apply for the Prop 64 Cohort 4 Grant must be a local jurisdiction* <br />that either: <br /> <br />1. Allows the retail sale of cannabis in storefronts. <br />OR <br />2. For jurisdictions with a population of 10,000 residents or less, allow s cannabis <br />delivery in the jurisdiction that serves both medicinal and adult-use consumers. <br /> <br />* For purposes of this RFP, “local jurisdiction” means a city, county, or city and county <br />in the State of California. (Bus. & Prof. Code § 26001(am).). <br /> <br />Please note: If the local jurisdiction only restricts the retail sale of cannabis to specific <br />locations pursuant to local zoning ordinances, or if the local jurisdiction requires licensure <br />for specific retail sales activities provided that such restrictions do not result in the <br />prohibition of all retail sales in the local government’s jurisdiction/authority, the local <br />jurisdiction may be eligible to apply for the Prop 64 Cohort 4 Grant. <br /> <br />Local jurisdictions in California must meet the above eligibility criteria by March 30, 2026, <br />to be considered for funding under the Prop 64 Cohort 4 Grant Program and must <br />maintain eligibility for the duration of the grant period. <br /> <br />Proof of Eligibility <br />It is up to the applicant to demonstrate to the BSCC that they meet the eligibility criteria <br />listed above. Prospective applicants are advised to consult with local counsel. <br /> <br />Applicants are required to submit a Letter of Eligibility (as part of the RFP submittal <br />process), detailing how the city, county, or city and county meets the above criteria, <br />including the dates the regulations, ordinances, or amendments to local jurisdiction <br />charters became enacted/effective (see Appendix A). Jurisdictions in the process of <br />legalizing the cultivation or retail sale of marijuana or marijuana products will be ineligible <br />for current funding under the Prop 64 Cohort 4 Grant Program. <br /> <br />Additionally, if a grant award is made to a city, county, or city and county (eligible at the <br />time of award) but becomes ineligible post -award, the contract with the Grantee will be <br />terminated and any remaining funds will cease to be disbursed for the rest of the contract <br />term. <br /> <br />Applicants may want to review the data compiled by the Department of Cannabis Control <br />(DCC) for their jurisdiction at: https://cannabis.ca.gov/cannabis-laws/where-cannabis- <br />businesses-are-allowed/.
