respective officers, agents and employees against any and all claims excluding those <br />arising out of the negligence or misconduct of Lessor and that Lessor has the option to <br />require Lessee to surrender all improvements made on the Leased Premises to Lessor <br />upon expiration of the Lease, as amended. <br />The Second Amendment further requires that Lessee provide Lessor with a <br />Security Deposit in the amount of $2,500. <br />A copy of the Second Amendment entitled, "Second Amendment to Lease <br />Agreement (Sequoia Yacht Club — Redwood City Marina Club House Facilities)" is on <br />file in the office of the Port Executive Director, to which copy reference is hereby made <br />for the full particulars thereof. <br />Section 2. The President and Secretary of the Board of Port Commissioners of <br />the City of Redwood City are hereby authorized and directed to execute the aforesaid <br />amendment to lease agreement for and on behalf of the City of Redwood City, acting by <br />and through its Board of Port Commissioners. <br />Section 3.
