While those agreements have come and gone, the permits Respondents <br />filed in November 2022 to correct the roofline extension have remained <br />unprocessed. <br />Respondents’ September 19, 2025 written request to extend the permits <br />stated the cause of the delay in plain words: “These permits have been <br />blocked by Engineering, following the reversal of the agreement reached <br />on July 24, 2024. Because staff have refused to revisit this reversal, I have <br />been prevented from exercising my rights under the permits through no <br />fault of my own.” <br />The wall-and-gate dispute is the same dispute that, in February and March <br />2026, the City formalized as Violations 2 and 3 of the present citation: the <br />engineering-permit and stormwater-easement count (Violation 2) and the <br />visibility-triangle count (Violation 3). <br />For seven years, the City held Respondents’ permits hostage. Plan-check <br />progress was conditioned on Respondents’ acceptance of demolition <br />demands the City could not consistently articulate. Three of the City’s own <br />senior officials agreed in writing those demands were not necessary. The <br />licensed engineer Respondents paid concluded the demands would <br />damage the City’s own drainage infrastructure. The demands persisted <br />anyway. <br />What the record shows is a pattern: agreement by senior City staff, <br />repudiation by other staff, no consistent City position, and Respondents <br />bearing the cost of every iteration. The permits are the casualty. <br />Of note as to the leverage pattern: the visibility-triangle count (Violation <br />3) was added despite the relevant geometry being plainly shown on the <br />architectural plans Respondents had already submitted with Permits <br />ADU22-0064 and C22-0027, and despite photographs Respondents had <br />previously provided to the Code Enforcement Officer addressing the same <br />area.
