7. Relief Requested <br />Respondents respectfully request that the City Council: <br />A. Reinstate Permit ADU22-0064 (the permit that resolves Violation 1) <br />and Permit C22-0027 (the unrelated main-house renovation, also paid <br />for and held in plan check) in their entirety, at no additional cost to <br />Respondents, and direct that plan check proceed on both. Respondents <br />are seeking only what was already pending when the dispute arose: an <br />open ADU permit covering the corrective demolition of the 2018 work, <br />and a separate open civil/site permit for the unrelated main-house <br />renovation. All applicable plan-check and permit fees totaling <br />$10,650.67 — $3,642.02 for ADU22-0064 and $7,008.65 for C22-0027 <br />— were paid in full to the City on January 19, 2023; reinstatement <br />should not require re-payment or re-application. All plan-review <br />timelines should be tolled from September 19, 2025 (the date Respondents <br />formally requested extension under California Building Code § 105.5) <br />until the City completes plan check and issues the permits; <br />B. Direct the Building Division to complete plan check and issue both <br />permits within sixty days of this Council decision; <br />C. Stay Violation 1 pending issuance of the permits, and vacate the <br />citation administratively upon issuance of the permits and completion of <br />the approved corrective work within the permits’ scope; <br />D. Refund the $300 hearing deposit and any reinspection fees assessed in <br />connection with this matter. <br />In plain language: open the permits Respondents already paid for.
