Five days after the O’Connell meeting, Engineering Assistant <br />Christian Craig put the O’Connell agreement in writing as the City’s <br />official corrections list: get a stamped engineer’s opinion on the wall and <br />channel, and if both are in good condition, the wall stays. <br />Significance. This is the City’s own written acceptance of the O’Connell <br />terms. The City cannot now say there was no agreement: the agreement <br />was reduced to writing and adopted into the corrections list by the very <br />Engineering staff member who later repudiated it. Mr. Craig’s later <br />admission (Exhibit YY) that he “reaffirmed” the contrary position with <br />Mr. Schwob in January 2025 confirms he understood this written <br />agreement existed and chose to walk it back. <br />6.A. - Page 45 of 64 <br />47
