Schwob agreement email, July 22, 2024 <br />Exhibit N — Jeff Schwob to Stephen Burns <br />October 25, 2024 — reconfirmation, forwarding the July 22 <br />agreement back to Respondents <br />Issue. Three months after the July 22, 2024 agreement, Mr. Schwob sent <br />the entire July agreement back to Respondents and confirmed: “I believe <br />this is the agreement we reached.” The Community Development Director <br />treated the July 22 agreement as still operative as of late October 2024. <br />Significance. This forecloses any City argument that the July 22 <br />agreement was tentative, conditional, or quickly superseded. The Director <br />restated the agreement in his own words and forwarded the original <br />verbatim. Respondents continued to rely. The next step in the agreed path <br />— resubmission of plans incorporating the shortened wall and fence <br />design — followed in January 2025. This makes the City’s later position <br />(that there was never an agreement) directly contradicted by the City’s <br />own Director, in writing, four months later. <br />6.A. - Page 51 of 64 <br />53
