Surplus Land Act <br />If the City facilitates development at the Site, the City must declare the Site as <br />“surplus land” or “exempt surplus land” prior to issuing a Request for <br />Proposals (RFP). <br />•Surplus Land: Site must first be offered for affordable housing, and preference <br />must be given to proposed project with greatest number of affordable units. <br />•Exempt Surplus Land: Preference can be given to any project that meets <br />selected exemption requirements stated in the SLA. Provides the City and <br />community greater flexibility to consider factors other than number of units <br />during the development selection process. The only applicable exemptions for <br />the Site may be affordable housing exemptions, which allow commercial <br />components. <br />RSG recommends pursuing an exempt surplus declaration given City’s goal to <br />maintain public parking on site. <br />May 11, 2026 Middlefield Library Lot B Design & Feasibility Analysis 22
