However, if City Council chooses to move forward with this <br />option, City staff have prepared two potential temporary exclusion scenarios for consideration. <br />The first scenario is to exclude locally designated historic resources only, as shown in Figure 5 <br />above. The second option is to exclude all eligible sites as shown in yellow in Figure 6 above. City <br />staff have prepared ordinances for each of these scenarios for City Council consideration, which <br />are included with this staff report as Attachments B and C. <br />C.Develop Local Transit-Oriented Development Alternative Plan – SB 79 allows local jurisdictions <br />to adopt a Transit-Oriented Development Alternative Plan (TOD Alternative Plan) for the 0.5-mile <br />radius around applicable transit stations, which provides some flexibility to redistribute <br />development capacity within transit-oriented areas. A TOD Alternative Plan may be adopted at <br />any time after SB 79’s effective date (July 1, 2026), must be reviewed for compliance by HCD, and <br />must comply with the following SB 79 requirements: <br /> <br />Capacity Maintenance and Redistribution – Development capacity may be shifted between <br />transit-oriented development zones but must remain within transit-oriented areas.
