ATTY/ORD.0006/CC ORD ADOPT AMENDMENTS TO THE ZONING CODE <br />REV: 07-08-26 MI <br />Page 2 of 5 <br />WHEREAS, the Zoning Code requires regular maintenance to ensure that its <br />provisions remain clear and accessible to the public, City staff, and decision-makers; that <br />it remains internally consistent; and that it remains consistent with the General Plan, City <br />policies, and State law; and <br /> <br />WHEREAS, to implement the Housing Element, development review streamlining, <br />and Zoning Code maintenance, updates and text amendments are required for Articles <br />2, 4, 5, 6, 8, 9, 10, 11, 14,17, 17A, 18, 29, 30, 31, 32, 33, 36, 37, 40, 41, 45, 48, 53, 54, <br />55, 57, and 60 (collectively, the “Zoning Code Amendments”), which accomplish the <br />following: <br /> <br />• Implement Housing Element Program H1-8 to support development on small <br />lots; <br /> <br />• Implement Housing Element Program H3-3 to support and expand housing <br />opportunities for extremely low-income households and households with <br />special needs; <br /> <br />• Implement Housing Element Program H4-7 to revise parking standards to <br />support housing development; <br /> <br />• Implement development review streamlining to: <br /> <br />o Allow ministerial approval of 100% affordable housing projects with no <br />public hearing; <br /> <br />o Update the review threshold requirement for taking development <br />projects to Planning Commission for review; <br /> <br />o Extend the length of time a development entitlement is valid; <br /> <br />o Extend the length of time to start rebuilding a legal nonconforming home <br />damaged by natural events; <br /> <br />• Implement Zoning Code maintenance to: <br /> <br />o Clarify definitions, define new terms, and delete obsolete definitions; <br /> <br />o Correct typographical errors and unintended insertions and deletions <br />that occurred during previous code updates; <br /> <br />o Remove outdated and/or obsolete content that no longer reflects current <br />policies or practices; <br /> <br />o Ensure consistency with State law; <br /> <br />8.B. - Page 19 of 212 <br />334
