ATTY/ORD.0006/CC ORD ADOPT AMENDMENTS TO THE ZONING CODE – EXHIBIT A <br />REV: 07-08-26 MI <br />Page 24 of 103 <br />the form of a resale or rental restrictions, deeds of trust, option agreements, or regulatory <br />agreement, as applicable, in a form approved by the City Attorney and executed by the City Manager <br />to ensure the continued affordability of the affordable units and implementation of the local <br />preference required under this Article. The agreement securing the affordable units required under <br />the Ordinance must at all times remain a lien recorded in first lien priority and may not be <br />subordinated to any lien securing a mortgage or indebtedness or other security financing interest <br />without the prior written consent of the City Manager City Council, who may, at their discretion, <br />refer the request to the City Council for approval. Such which consent can be withheld at the City's <br />sole and absolute discretion. Approval of an affordable housing agreement is a condition of any <br />discretionary or ministerial permit for any development project to which this Article applies, unless <br />the developer is only paying an affordable housing impact fee, in compliance with the City <br />requirements. <br /> <br />Article 30 - OFF-STREET PARKING AND LOADING[1] <br />[Only changes are to Sections 30.2, 30.4, 30.5, 30.6, 30.18 and ADDED 30.19] <br />30.2 - Required Number of Parking Spaces— P-Downtown (Downtown Precise Plan) <br />District Downtown Parking Zone. <br />In the P-Downtown (Downtown Precise Plan) District, off-street parking spaces for vehicles shall be <br />provided in accordance with the schedule in the Downtown Precise Plan. In all zoning districts in <br />connection with every use of property and for each building site located within the area which shall be <br />known as the Downtown Parking Zone as established by resolution of the City Council, and which is <br />delineated on the map entitled "Downtown Parking Zone," on file in the office of the City Clerk available <br />for public inspection, there shall be provided off-street parking spaces for vehicles according to the <br />following schedule: <br />(Wherever square feet of floor area is indicated, it shall mean gross square footage.) <br />A. Residential Uses. <br />1. Dwellings, containing two (2) bedrooms or more: <br />a. Minimum Required: one and a half (1.5) parking spaces per dwelling unit; <br />b. Maximum Allowed: three (3) parking spaces per dwelling unit. <br />2. Dwellings, containing one (1) bedroom: <br />a. Minimum Required: one (1) parking space per dwelling unit; <br />b. Maximum Allowed: two (2) parking spaces per dwelling unit. <br />3. Dwellings, studio apartments: <br />a. Minimum Required: three-quarters (0.75) of a parking space per dwelling unit; <br />b.
