All applications for accessory dwelling units that comply with the requirements <br />under this Article shall be reviewed through a building permit within sixty (60) days after receipt of <br />a complete application if there is an existing single-family dwelling, duplex, or multifamily dwelling <br />on the lot. An application shall be denied if the proposed accessory dwelling unit does not comply <br />with all applicable requirements of this Article. If the application involves an accessory dwelling unit <br />where there is also an application for a new single-family dwelling on the lot, then the Director may <br />delay action on the accessory dwelling unit application to coincide with the single-family dwelling <br />application as long as the Director applies the ministerial review required by this Section to the <br />accessory dwelling unit. Applicants may request a delay or waive the sixty-day approval period. <br /> <br />---- <br /> <br />Article 40 - POWERS AND DUTIES OF PLANNING BODIES[1] <br />[Changes are only to Sections 40.4 and 40.7] <br />40.4 Planning Commission Powers and Duties. <br />The Planning Commission shall have the powers and duties assigned by the City Council, including but not <br />limited to: <br />A. Holding a public hearing as required. <br />B. Making decisions on applications subject to Planning Commission review. <br />C. Making recommendations to City Council on General Plan and Zoning Ordinance amendments, <br />new or amended specific plans or precise plans. <br />D. Making determinations or recommendations on applications requiring a Negative Declaration, <br />Mitigated Negative Declaration or Environmental Impact Report (EIR). <br />E. Appointing members of the public to the Historic Resources Advisory Committee and Architectural <br />Advisory Committee. <br />F. Appointing a member of the Planning Commission as a member of the Subdivision Committee. <br /> <br />40.7 Subdivision Committee Powers and DutiesReserved. <br />The Subdivision Committee shall have powers and duties as specified in Municipal Code Section 30.6 <br />(Functions of the Subdivision Committee). <br /> <br />----- <br /> <br />8.B. - Page 89 of 212 <br />404
