REV:06-01-26 LF <br />“3. Agreement Term. The term of the Agreement shall terminate on July 6, 2031 <br />or upon receipt of Case Closure for the Environmental Condition, whichever is <br />earlier.” <br />4. Section 9 (“Notices”) of the Agreement is hereby amended as follows: <br />a. The Parties acknowledge that the Staging Area described and depicted in Exhibit <br />“B” of the Agreement was established for intensive remediation activities performed in <br />previous years. The Parties agree that the City no longer requires the use of the Staging <br />Area for the Work. However, if a need for a staging area arises for any future Work under <br />the Agreement, the Owner and City will meet and confer to determine a mutually <br />acceptable staging location at that time. Both parties agree that the City has removed all <br />materials and equipment and any temporary fencing from the Staging Area to the Owner’s <br />satisfaction. <br />6. All other provisions of the Agreement will remain in full force and effect. <br />7.
