5. The first sentence of Section 4 of the Agreement is amended to read as <br />follows: <br />Developer will complete the Work by May 1, 2030. <br />6. Notwithstanding anything to the contrary in the Agreement, the warranty <br />security contemplated by Subsection 13.1(c) shall only be provided as follows: (a) warranty <br />security in the amount of ten percent (10%) of the Estimated Cost of Work with respect to <br />the Work accepted by the City as of the First Amendment Effective Date (the "Accepted <br />Work") shall be furnished for a period of one (1) year following City Council acceptance of <br />the Accepted Work, and (b) further warranty security shall be furnished in the amount of <br />ten percent (10%) of the Estimated Cost of Work with respect to any Work accepted by the <br />City Council after the First Amendment Effective Date for a period of one (1) year after such <br />acceptance. <br />7. Except as expressly modified by this First Amendment, all of the terms and <br />conditions of the Agreement shall remain in full force and effect. <br />8.
