Page 5 of 6 <br />City of Redwood City 1017 Middlefield Road, Redwood City, CA. 94063 Tel: 650-780-7000 www.redwoodcity.org <br />Staff proposes requesting an amendment defining material disparity as a statistically significant <br />difference that is meaningful in magnitude, established by competent evidence, and not attributable <br />to chance, or, in the alternative, direction to the Attorney General to issue early interpretive guidance. <br />A discernible standard protects good-faith agencies, gives courts a consistent test, and strengthens <br />the act against vagueness challenges. <br />A draft letter outlining these concerns and proposals is included as Attachment B. Should the City Council <br />adopt staff’s recommendation to “Oppose Unless Amended,” the letter will be finalized, formatted and <br />transmitted. <br />EQUITY IMPACT STATEMENT <br />All City actions are assessed for impact. Because this item is on the consent calendar, this section indicates <br />assessment process, not findings. The anticipated impact of this policy, program, or action has been <br />assessed in the following ways: <br />Reviewed from similar or relevant past program or policy in Redwood City <br />FISCAL IMPACT <br />If enacted, the bill could have fiscal implications for the City. However, there is no direct fiscal impact <br />associated with adopting a legislative position on SB 1164. <br />ENVIRONMENTAL REVIEW <br />This activity is not a project under California Environmental Quality Act (CEQA) as defined in CEQA <br />Guidelines, section 15378, because it has no potential for resulting in either a direct or reasonably <br />foreseeable indirect physical change in the environment. <br />PUBLIC NOTICE <br />Public notification was achieved by posting the agenda, with the agenda items being listed, at least 72 <br />hours prior to the meeting. <br />ALTERNATIVES <br />Staff’s recommendation is to adopt, by motion, an “Oppose Unless Amended” position on State legislation <br />SB 1164 (Cervantes) Elections, and direct staff to finalize and submit a letter communicating the City’s <br />position to the appropriate State legislative representatives.
