IX.Findings of Approval <br />Pursuant to Section 29.7D of the Affordable Housing Ordinance, the City Council may approve an <br />Affordable Housing Plan proposing any alternative method of compliance including a land donation if <br />the City Council is able to make all of the findings in Section 29.7C (Approval of On-Site Affordable Units) <br />and the proposal meets all of conditions in Section 29.7 D (Approval of Off-Site Affordable Units), each <br />of which the Amended and Restated Affordable Housing Plan for the Substitute Site meets, as follows: <br />Section 29.7 C Approval of On-Site Affordable Units <br />1. The proposed affordable units <br />comply with the applicable <br />standards in the Affordable <br />Housing Ordinance, including, <br />without limitation, the <br />requirement that the affordable <br />units be made available for <br />concurrent occupancy per Section <br />29.6B <br />This finding can be made. See Section VII, item N. <br />2. The affordable units will mitigate <br />the impact of the project on the <br />need for affordable housing if the <br />units are provided under the <br />Affordable Housing Impact Fee <br />Program <br />This finding can be made. See Attachment 10 which <br />explains how the proposed donation of the <br />Substitute Site to Eden and the Eden Project in turn <br />will mitigate the impacts of the Lane Project. <br />Section 29.7 D Approval of Off-Site Affordable Units <br />1. Financing or a viable financing plan, <br />which may include public funding <br />sources, is in place for the <br />proposed affordable housing units; <br />This finding can be made. See Section VIII, Item M. <br />2. The proposed location is suitable <br />for the proposed affordable <br />housing, is consistent with the <br />Housing Element, general plan, and <br />This finding can be made.
