ATTY/ORD.0007/CC ORD ADOPT AMENDMENTS TO THE MUNICIPAL CODE – EXHIBIT A <br />REV: 07-08-26 MI <br />Page 12 of 19 <br />1. Drainage structures shall be designed in accordance with the City Engineering Standards to <br />avoid lot damage by the one hundred-year storm/flood hazard. <br />2. Drainage from individual lots shall be retained onsite and the overflow be toward the street or <br />toward a natural drainage course. For downhill side lots in hillside divisions, drainage shall be <br />designed to avoid or minimize the effect thereof on lots located at lower elevations. <br />3. Wherever a natural or a planned drainage course traverses a subdivision, a maintenance and/or <br />open space easement shall be dedicated by the subdivider for the safe disposal of storm waters. <br />4. Drainage structures shall be designed and installed to a grade, which installation shall be <br />confirmed by the City Engineer. <br />5. Please add reference to Projects shall be designed in accordance with the City's Green <br />Infrastructure GI ordinance, as may be amended from time to time. <br />G. The subdivider shall contact the applicable franchisee of a CATV franchise in the City to determine <br />the requirements of the franchise for the installation of a CATV underground system for that <br />subdivision and shall perform its construction activities in a manner which will facilitate the <br />installation of such system by the franchisee. <br />H. The subdivider shall be responsible for the design, installation, repair, replacement, and/or upgrade <br />of flood protection improvements, including, but not limited to, levees, if the existing flood <br />protection improvements fail to meet the applicable flood protection standards, including, but not <br />limited to, the City's adopted sea level rise assessment, at the time of the application. <br /> <br />ARTICLE X. – CONDOMINIUMS <br /> [Only changes to Section 30.62] <br />Sec. 30.62. ADDITIONAL REQUIREMENTS FOR CONVERSION TO CONDOMINIUMS: <br />In addition to all other provisions of this Article, an applicant for a condominium permit for a proposed <br />conversion shall include in such application the following: <br />A. A property report describing the condition and useful life of the roof, foundations, paving, <br />mechanical, electrical, plumbing, walls, floors, and structural elements of all existing buildings and <br />structures. Said report shall also contain an evaluation of noise and energy insulation features of the <br />building in comparison to current State regulations applicable to buildings and structures. Such <br />report shall be prepared by a registered civil or structural engineer, architect, or a licensed general <br />building contractor or general engineering contractor. <br />B. A structural pest control report prepared by a licensed structural pest control operator pursuant to <br />Business and Professions Code Section 8516 relating to written reports on the absence or presence <br />of wood-destroying pests or organisms. <br />C. Proof of compliance with all tenant notice requirements for conversion in Government Code Section <br />66427.1. <br />D. A report from the Building Department, Fire Department and Community Development Director or <br />Zoning Administrator as to whether the project complies, and the extent or degree of compliance, <br />with current provisions of the City's building regulations, fire codes and the Zoning Ordinance.
