ATTY/ORD.0006/CC ORD ADOPT AMENDMENTS TO THE ZONING CODE <br />REV: 07-16-26 MI <br />Page 3 of 5 <br />o Provide minor updates that clarify, modify, and/or streamline current <br />policy and processes; and <br /> <br />WHEREAS, the City’s Accessory Dwelling Units (ADU) Ordinance is codified in <br />Article 37 of the Zoning Code; State ADU law is amended every year by the State <br />legislature, which requires repeated amendments to the City’s Zoning Code to maintain <br />compliance with State ADU law; State ADU law provides jurisdictions with limited <br />discretion in regulating ADUs beyond State ADU law; State ADU law provides sufficient <br />enforcement of development standards to regulate ADUs; and therefore the Zoning Code <br />Amendments repeal the City’s ADU Ordinance and regulation of ADUs will revert to State <br />ADU law; and <br /> <br />WHEREAS, the Planning Commission is required to make a recommendation on <br />amendments to the Zoning Code to the City Council. Modifications to the various Articles <br />listed herein would further the purposes of the Housing Element, the General Plan, and <br />the Zoning Code; and <br /> <br />WHEREAS, on May 5, 2026, the Planning Commission held a duly noticed public <br />hearing, in accordance with all applicable requirements of the Redwood City Zoning <br />Code, to consider the Zoning Code Amendments shown in Exhibit A; and <br /> <br />WHEREAS, the Planning Commission voted 5-1-1 to adopt a resolution <br />recommending that the City Council adopt the Zoning Code Amendments shown in <br />Exhibit A; and <br /> <br />WHEREAS, on June 23, 2026, a public notice of these amendments was <br />circulated in the San Mateo Daily Journal; and <br /> <br />WHEREAS, on July 13, 2026, the City Council held a duly noticed public hearing, <br />in accordance with all applicable requirements of the Redwood City Zoning Code, to <br />consider the Zoning Code Amendments shown in Exhibit A; and <br /> <br />WHEREAS, after the public hearing, the City Council has considered the whole of <br />the record related to the Zoning Code, including all relevant testimony, and determined <br />that it desires to adopt the Amendments shown in Exhibit A. <br /> <br />NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY <br />OF REDWOOD CITY, DOES ORDAIN AS FOLLOWS: <br /> <br />Section 1. Recitals. The recitals set forth above are true and correct and are <br />hereby incorporated herein by this reference as findings as if fully set forth in their entirety. <br /> <br />Section 2. Findings. In accordance with all requirements of Article 49 of the <br />Zoning Code, the City Council hereby finds that the proposed Zoning Code Amendments <br />(“Amendments”) are in the public interest, are consistent with the Redwood City General <br />Plan, and increase the quality of the provisions of the Zoning Code in guiding and
