As our local community <br />evaluates project substitutions, it is critical to recognize the statutory <br />compliance obligations that will remain in effect for any substituted <br />developments. <br />For housing developments subject to SB 423, the following labor <br />requirements apply: <br />● Apprenticeship Program Participation: Contractors employing <br />construction craft employees (or those entering subcontracts for at <br />least 1,000 hours) are required to either participate in a <br />state-approved apprenticeship program or request the dispatch of <br />apprentices from such a program. This necessitates notifying <br />relevant apprenticeship programs about the development and <br />employing apprentices in a ratio of their approved state standards. <br />● Health Care Expenditures: Contractors are required to make <br />health care expenditures for each construction craft employee, tied <br />to the hourly pro rata cost as specified. <br />● Compliance Reporting: Development proponents must provide <br />monthly reports to the local agency to demonstrate adherence to <br />these apprenticeship and health care requirements. Failure to meet <br />these standards carries the potential for penalties. <br />● Payroll Documentation: Contractors must maintain and submit <br />certified payroll records to the Labor Commissioner for these <br />projects. <br />
