<br />RES 0 L UTI 0 N <br />------------ <br /> <br />If 0 . 1563 <br /> <br />GRANTING VARIANCE TO H. BRENNAN TO ALLOW 1 THREE-FOOT <br />FENCE ABOVE RETAINING WALL, CAR PORT, AND TO CONVERT <br />GARAGE TO DWELLING ROOM AT 2796 IVCASSACHUSETTS AVENUE <br /> <br />WHEREAS, the Board of Adjustments of the Planning Commission <br /> <br /> <br />of the City of Redwood City, State of California, has submitted <br /> <br />the application of H. Brennan for a variance or adjustment with <br /> <br /> <br />the recommendation that such application be granted; and, <br /> <br />WHEREAS, the Council of Redwood City has considered said <br /> <br />application for variance or adjustment in accordance with section <br />20 of Ordinance No. 600, being the zoning ordinance of the City of <br /> <br />Redwood City; <br /> <br />NOW, THEREFORE, the Council of Redwood City hereby resolves <br /> <br />as follows: <br /> <br />(1) Said Council finds that the following conditions do <br /> <br />exist: <br /> <br />{a} That there are exceptional or extraordinary <br />circumstances which apply to the land, building <br />or use referred to in the application, which <br />circumstances or conditions do not apply generally <br />to land, buildings, or uses in the same district. <br /> <br />(b) That the granting of the application is nec- <br />essary for the preservation and enjoyment of sub- <br />stantial property rights of the petitioner. <br /> <br />(c) That the granting of such application will <br />not materially affect adversely neighboring prop- <br />erty, public welfare, or the health or safety of <br />persons residing or working in the neighborhood. <br /> <br />(2) Said Council hereby gl'ants said adjustment or variance <br /> <br />to H. Brennan to allow construction of a three-foot wooden fence <br /> <br />on top of an existing retaining wall and adding a car port in the <br /> <br />rear yard, and allowing remodeling of garage into residence <br />quarters at 2796 Massachusetts Avenue, Redwoo~ City, California, <br />subject to the condi tion tha t the cons.tl"uction' of the fence, car <br /> <br />port, and conversion of the garage be completed in accordance <br /> <br />with plans submitted to the Planning Commission and Councilor <br /> <br />- 1 - <br />
