WHEREAS, the Board of Adjustments of the Planning Commission of the City of Redwood City, State of California, has submitted the applica tion of JosephSiPhopp for variance or adjustment wi th recownendation that such application be granted; and, WHEREAS, the City Council of the City of Redwood City has considered said application for variance or adjustment in accord- ance with Section 20 of Ordinance No. " '.000, being the Zoning Or- dinance of the City of Redwood City; and, NOW, THEREF10RE, the Council of Redwood City hereby resolves as follows: 1. Said Council hereby finds that the following conditions exist: (a) That there are exceptional or extraordinary circum- stances which apply to the land, building or use referred to in the application which circumstances or conditions do not generally apply to land, buildings or uses in the same distx1ict. (b) That the granting of the application is necessary for the preservation and enjoyment of substantial property rights of the petitioner. (c) That the granting of such application will not materially effect adversely neighboring property or the public welfare, or the haalth or safety of persons residing or working in the neighborhood. 2. Said Council hereby grants to JosephSmlOpp a variance in the side-yard requirements on Lots I and 2, Block 12, I'Kensing- ton Square", reducing the side-yard requirements, in fact actually the rear yard on said lots, to zero teet subject to the condition that construction of the improvements will be carried out in accord- ance with plans heretofore submitted to the Planning Commission and '- I -
