I <br />RESOLUTION N0. 1 <br />GRANTING VARIANCE TO ALLEN BROS. TO <br />ALLOW AN ILLEGAL OVERHANG TO REMAIN <br />ON THE REAR OF STRUCTURE AT 426 MADISON <br />STREET. <br />WHEREAS, the Planning Commission of Redwood City has sub- <br />witted the application of ALLEN BROS. for variance with the <br />recommendation that such application be granted conditionally; <br />and <br />WHEREAS ". the Council of the City of Redwood City has <br />considered said application for variance in accordance with <br />Section 20 of Ordinance No. 600, said ordinance being the <br />Zoning Ordinance of the City of Redwood City; <br />NOW, THEREFORE , THE C OUiUC I L OF REDWOOD CITY H7 REBY <br />RESOLVES AS FOLLOWS: <br />1. Said Council finds the following conditions exist: <br />(a) That there are exceptional or extraordinary <br />circumstances which apply to the land, building or <br />use referred to in the application which circum- <br />stances or conditions do not generally apply to <br />land, buildings or uses in the same district. <br />(b) That the granting of the application is <br />necessary for the preservation and enjoyment of <br />substantial property rights of the petitioner. <br />(c) That the granting of such application <br />vi 11 not materially affect adversely neighboring <br />property or the public welfare or the health or <br />safety of persons residing or working in. the <br />neighborhood. <br />2. Said Council hereby grants to ALLEN BROS. a variance <br />to allow an illegal overhang to remain on the rear of a <br />structure at 426 Madison Street, Redwood City, San Mateo County, <br />California, subject to the condition that it be removed at any <br />time on order of the Council of the City of Redwood City. <br />
