RESOLUTION N0. 1730 GRANTING VARIANCE TO J"ES NICHOIAS, TO ALLOW EXTENSION OF R -4 USE TO ALL OF LOT 1 BLOCK 17 DINGEE PARK. WHERE,S, the Planning Commission of Redwood City has submitted the application of JAMES NICHOLAS for variance with the recommendation that such application be granted, and WHEREAS, the Council of Redwood City has considered said application for variance in accordance with Section 20 of Ordinance No. 600, said ordinance being the zoning ordinance of the City of Redwood City, NOW, THEREFORE, THE COUNCIL OF REDWOOD CITY HEREBY RESOLVE AS FOLLOWS. 1. Said Council finds the following conditions exist: a) That there are exceptional or extraordinary circumstances which apply to the land, building or use referred to in the application, which circumstances or conditions do not generally apply to lands, buildings or uses in the same district. b) That the granting of the application is necessary for the preservation and enjoyment of sub- stantial property rights of the petitioner. c) That the granting of such application will not materially affect adversely neighboring property or the public welfare or the health or safety of persons residing or working in the neighborhood. 2. Said Council hereby grants to JAMES NICHOIAS a variance to allow the extension of the R -4 use to all of Lot 1 Block 17 Dingee Park, subject to the following conditions: a) Construction of the improvements will be commenced within six (6) months from the date of this resolution and will be diligently prosecuted to completion thereafter. b) Construction on the premises shall be limited to three (3) units and two (2) stories and shall be constructed strictly in accordance with the plans heretofore sub - mitted to and approved by the Planning Commission of Redwood City. c} The proposed improvements shall be so located -1-
