RESOLUTION N0. 1730 <br />GRANTING VARIANCE TO J"ES NICHOIAS, TO <br />ALLOW EXTENSION OF R -4 USE TO ALL OF LOT <br />1 BLOCK 17 DINGEE PARK. <br />WHERE,S, the Planning Commission of Redwood City has <br />submitted the application of JAMES NICHOLAS for variance with <br />the recommendation that such application be granted, and <br />WHEREAS, the Council of Redwood City has considered said <br />application for variance in accordance with Section 20 of <br />Ordinance No. 600, said ordinance being the zoning ordinance of <br />the City of Redwood City, <br />NOW, THEREFORE, THE COUNCIL OF REDWOOD CITY HEREBY RESOLVE <br />AS FOLLOWS. <br />1. Said Council finds the following conditions exist: <br />a) That there are exceptional or extraordinary <br />circumstances which apply to the land, building or use <br />referred to in the application, which circumstances or <br />conditions do not generally apply to lands, buildings <br />or uses in the same district. <br />b) That the granting of the application is <br />necessary for the preservation and enjoyment of sub- <br />stantial property rights of the petitioner. <br />c) That the granting of such application will not <br />materially affect adversely neighboring property or <br />the public welfare or the health or safety of persons <br />residing or working in the neighborhood. <br />2. Said Council hereby grants to JAMES NICHOIAS a <br />variance to allow the extension of the R -4 use to all of Lot 1 <br />Block 17 Dingee Park, subject to the following conditions: <br />a) Construction of the improvements will be commenced <br />within six (6) months from the date of this resolution <br />and will be diligently prosecuted to completion thereafter. <br />b) Construction on the premises shall be limited to <br />three (3) units and two (2) stories and shall be constructed <br />strictly in accordance with the plans heretofore sub - <br />mitted to and approved by the Planning Commission of <br />Redwood City. <br />c} The proposed improvements shall be so located <br />-1- <br />
