RES OLUTI ON N0. 1881 CANCELLING CONTRACT FOR PUBLIC IMPROVE- MENTS LIGUORI STREET, BROADWAY, . ETC . WHEREAS, by Agreement dated September 19., 194 , which Agreement was recorded in Volume 1200 of Official Records at Page 332 in the Office of the Recorder of San Mateo County, California., on September 21, 1945, City of Redwood City and certain property owners entered into an agreement with respect to the installation of certain street improvements in a subdiv- ision known as "Broadway Redwood City., California"; and WHEREAS the principal. purposes of said agreement have been accomplished through Assessment District Proceedings; and WHEREAS., it is the desire of the parties to said agree- ment and the City of Redwood City to cancel their agreement: NOW., THEREFORE., THE COUNCIL OF REDWOOD CITY HEREBY RESOLVES AS FOLLOWS: 1. That the Agreement hereinbefore referred to is here- by cancelled and, the City of Redwood City hereby waives any and all rights to enforce any lien which may exist against any lots or parcels in said subdivision and the right to create any liens in the future pursuant to said Agreement, provided, however, that nothing herein shall affect in any way the right of the City of Redwood City to institute any further public proceedings for the construction of improvements which will result in .Z- assessments liens on the property and nothing herein shall be I- construed as affecting in any manner assessment proceedings here- tofore conducted by City which have resulted in assessment liens and bonds being issued against certain properties described in said agreement. 2. The Clerk of the City of Redwood City is hereby directed to record a certified copy of this resolution in the Office of the Recorder of San Mateo County, California.
