A moratorium ordinance requires a 4/5 majority vote (five out
seven City Council members) for enactment (one reading), is initially effective for 45
days, and may be extended by a 4/5 majority vote for 22 months and 15 days. If the
City Council were to adopt the attached ordinance, the forty-five day period would end
on, or about January 28, 2010. Thereafter, said ordinance could be extended by a 4/5
vote for an additional 22 months and 15 days.

California Government Code section 65858 mandates that ten days prior to the
expiration of an interim ordinance or any extension thereof, the City Council must issue
a written report describing steps that have been taken to study the issues and establish
appropriate policies and regulations. If the City Council adopts the attached ordinance,
issuance of said report would have to occur prior to January 28, 2010.

ALTERNAnVES
1.
