8A
Page 1~
Page 3

4. What sort of operational regulations should be required (i.e. hours, security etc.)?
5. Should the City adopt its own identification program or use another agency's
program?
6. Should licensing and criminal background check for operators and employees be
required?
7. If licensing is required, with what frequency should licenses be renewed?

Pursuant to Govemment Code section 65858, the City Council may adopt an interim
ordinance to establish a moratorium on the establishment and operation of medical
marijuana collectives/cooperatives within the City to allow staff additional time to
research the issues. A moratorium ordinance requires a 4/5 majority vote (five out
seven City Council members) for enactment (one reading), is initially effective for 45
days, and may be extended by a 4/5 majority vote for 22 months and 15 days. If the
City Council were to adopt the attached ordinance, the forty-five day period would end
on, or about January 28, 2010. Thereafter, said ordinance could be extended by a 4/5
vote for an additional 22 months and 15 days.

California Government Code section 65858 mandates that ten days prior to the
expiration of an interim ordinance or any extension thereof, the City Council must issue
a written report describing steps that have been taken to study the issues and establish
appropriate policies and regulations. If the City Council adopts the attached ordinance,
issuance of said report would have to occur prior to January 28, 2010.

ALTERNAnVES
1. Ban medical marijuana collectives outright.
2. Allow medical marijuana collectives, but regulate them.
3. Do not enact any regulation and by default allow collectives to exist with limited
regulation through a Use Permit review process.

FISCAL IMPACT
None.

~~
Sailesh Mehra
Associate Planner

.~~

Jill E. s, AICP
01 or, Planning, Housing and
Economic Development City Manager

ATTACHMENTS
1.
