The City Manager or designee shall also allow oral <br />argument. After all verbal testimony has been reviewed; the City Manager or <br />designee shall render a written decision within ten (10) working days from the <br />date the matter is submitted for decision. The action of the City Manager or <br />designee shall be final and conclusive, subject only to applicable court review. <br />(Ord. 2009-6 ~ 1, 2009). <br /> <br />ARTICLE 3. <br /> <br />MISCELLANEOUS PROVISIONS <br /> <br />7.46.090 ENFORCEMENT OF CHAPTER. The Police Chief or the Chief's <br />designee may investigate and enforce any violations of this chapter, and to report <br />and enforce against any violations of the conditions of approval attached to <br />licenses required by and obtained pursuant to this Chapter. The Chief may report <br />violations of these provisions to the License Committee, for possible revocation of <br />the license obtained under this Chapter. (Ord. 2009-6 ~ 1, 2009). <br /> <br />7.46.100 VIOLATIONS AND PENALTIES. Any violation of this chapter <br />shall be deemed a misdemeanor, unless the circumstances that create the <br />violation are subject to prosecution under state or federal law. Any violation of <br />this chapter shall also be deemed a public nuisance and may be enforced by any <br />remedy available to the City for abatement of public nuisances. (Ord. 2009-6 9 <br />1, 2009). <br /> <br />7.46.110 MARIJUANA PRODUCED FOR INDIVIDUAL RESIDENTIAL ON- <br />SITE CONSUMPTION. <br />(a) Nothing in this chapter shall be deemed to make unlawful an individual's <br />cultivation of medical marijuana at their own residence for their own use, or for <br />the use by another person regularly residing at such residence, if such cultivation, <br />possession or use is lawful under Health and Safety Code sections 11362.7 <br />through 11362.77. <br />(b) Marijuana cultivated and possessed at a private residence must not be <br />visible from adjacent public areas or neighboring properties, and must be secured <br />within structures consisting of at least four walls and a roof with standard locks. <br />(Ord. 2009-6 ~ 1, 2009). <br /> <br />7.46.120 SEVERABILITY. If any section, subsection, sentence, clause, or <br />phrase of this Chapter, is for any reason held to be invalid, unlawful, or <br />unconstitutional, such invalidity or unconstitutionality shall not affect the validity, <br />lawfulness, or constitutionality of any or all other portions of this Chapter.
