IMPACTS FOUND NOT TO BE SIGNIFICANT AND THUS.DO NOT REQUIRE
MITIGATION

Under CEQA, no mitigation measures are required for impacts that are less than significant.
(Pub. Resources Code, ~ 21002; CEQA Guidelines, ~~ 15126.4, subd. (a)(3), 15091.) Based on
the evidence in the whole record of this proceeding, the SFPUC finds that implementation of the
BDPL No.5 Project will not result in any significant impacts in the following areas and that
these impact areas therefore do not require mitigation:

Plans and Policies

. Consistency with San Francisco plans and policies; and,
. Consistency with other applicable land use plans and policies.

Agriculture

. Convert prime farmland, or farmland or statewide importance to a non-agricultural use;
. Conflict with zoning for agricultural use or a Williamson Act Contract; and,
. Other changes that could result in conversion of farmland to non-agricultural use.

Minerals; Energy and Water Consumption

. Loss of availability of a known mineral resource that would be of value to the region and
the residents of California;
. Loss of availability of a locally important mineral resource recovery site delineated in
local plans; and,
. Encourage activities that would result in the use of large amounts of fuel, water, or
energy, or use these resources in a wasteful manner.

Population and Housing

. Induce substantial population growth, either directly or indirectly;
. Displace substantial numbers of existing housing units or create demand for additional
housing, necessitating the construction of replacement housing; and,
. Displace substantial numbers of people, necessitating the construction of replacement
housing elsewhere.

Public Services

· .~.~.~~.lt.~~...~~~~~:t.1.~~1...~4Y..~!.s.~..P~y~t'?~.1..i.~}p'~~~s....Cls.~fJ.~i~~~4.. ~fu:..~~.P~9.y'j~~.<<?~..9..f,..9.r!h~........
... ....:...:.....:.:.....:...rieedfor;.new or physically altered governmental facilities...... ........... ........ .... ......... ... . .. .

ill. FINDINGS OF POTENTIALLY SIGNIFICANT IMP ACTS THAT CAN BE
A VOIDED OR REDUCED TO A LESS- THAN..SIGNIFICANT LEVEL THROUGH
MITIGATION AND THE DISPOSITION OF THE MITIGATION MEASURES

CEQA requires agencies to adopt mitigation measures that would avoid or substantially lessen a
project's identified significant impacts or potential significant impacts if such measures are
feasible (unless mitigation to such levels is achieved through adoption ofa project alternative).
The findings in this Section III and in Section IV concern mitigation measures set forth in the
EIR. These findings discuss mitigation measures as proposed in the ErR and recommended for

8
