REPORT

6.1F
Page 1

To the Honorable Mayor and City Council
From the Ci Mana er

February 8,2010

SUBJECT
Award of Contract - Red Morton Park, BBQ Area Shade Structure Project

RECOMMENDATION
1. Dismiss, by motion, a bid protest made by Redwood Engineering Construction and
waive minor irregularities contained in the successful bid for the reasons contained
in this report.

2. Approve, by motion, the contract documents and award the contract for the Red
Morton Park, SBQ Area Shade Structure Project to McNabb Construction, Inc. of
Lafayette for their responsive and responsible low bid of $162,400.00 and authorize
the City Manager to increase the contract amount up to 10% if necessary.

BACKGROUND
The Red Morton Park picnic area offers space for the community to hold private parties
and gatherings. After years of continued use, the picnic area's pavement and shade
structure need to be replaced.

The project involves replacing the picnic area's existing features with a new fabric
shade sail, concrete slabs and curbs, pavers, and BBQ equipment.

Ten (10) bids were received at the bid opening on Wednesday, December 30,2009 for
the "Red Morton Park, BBQ Area Shade Structure Project" and are summarized in the
table below.

Bidder Bid Amount
McNabb Construction. Inc. $162AOO.00
Redwood Enaineering Construction 163,224.50
HSR, Inc. 180,592.40
A.J. Vasconi 182,300.00
Blossom Vallev Construction 189.817.95
Nexgen Builders Inc. 190,648.79
G&G Builders 193,785.00
Rodan Builders 195,500.90
Sansei Gardens, Inc. 205,800.00
Bay Construction Co. 210,624.96
Engineer's Estimate $151,346.00
Recommended Bidder: McNabb Construction, Inc. of Lafayette
Substantiation: McNabb Construction, Inc. of Lafayette is the lowest
responsive and responsible bidder.

The low bid of $162,400.00 submitted by McNabb Construction, Inc. of Lafayette is
7.3% higher than the engineer's estimate. Staff attributes this variance to the shade
structure specification that only one shade structure manufacturer meets. Based on the
bids received, staff believes that the low bid of $162,400.00 is reasonable and
recommends awarding the contract to McNabb Construction, Inc.
