<br />01/25/2010 <br /> <br />WHEREAS, federal law classifies marijuana as a Schedule 1 drug with "no <br />accepted medical value in treatment," and continues to prohibit the cultivation, <br />possession distribution of marijuana; and <br />WHEREAS, if medical marijuana collectives were allowed to be <br />established without appropriate regulation, such uses might: 1) be established <br />under conditions that would conflict with the requirements of the General Plan, <br />the City's Zoning Ordinance (which is about to undergo review and amendment), <br />forthcoming City regulations, and state and/or federal law; 2) be inconsistent with <br />surrounding uses; and 3) be detrimental to the public health, safety and welfare; <br />and <br /> <br />WHEREAS, on December 14, 2009, the City Council adopted an <br />ordinance (Ordinance 2350) that imposed a forty-five (45) day moratorium on the <br />establishment and operation of medical marijuana collectives in the City to give <br />staff time to study the legality, potential adverse community impacts, and <br />mechanisms for regulation of medical marijuana collectives; and <br />WHEREAS, in accordance with the requirements of Government Code <br />section 65858, a twenty-two (22) month, fifteen (15) day extension of the <br />moratorium is needed for City staff to complete the analysis of the issue and <br />establish appropriate policies and regulations. <br /> <br />NOW, THEREFORE, THE COUNCIL OF THE CITY OF REDWOOD CITY <br />DOES ORDAIN AS FOLLOWS: <br /> <br />SECTION 1. Purpose and Findings <br /> <br />A. The above recitals are incorporated herein and are each relied <br />upon independently by the City Council for its adoption of this <br />interim ordinance. <br /> <br />B. The Redwood City General Plan does not presently contain a <br />goal or policy of textual discussion of the issue of a proposed <br />use of medical marijuana collectives. <br /> <br />C.
