<br />8A <br />Page 1 0 <br /> <br />'SB 88' Continued from Page 1... <br /> <br />The League opposes SB 88, as well as the nearly identical, AB 155 (Mendoza), because the bills <br />would require that a municipality seeking Chapter 9 federal bankruptcy protection first obtain <br />approval from the California Debt Investment and Advisory Commission prior to filing a <br />bankruptcy petition wilh a federal bankruptcy court. <br /> <br />Even if ultimately SB 88 is amended to deal with another issue, local officials should not think that <br />this issue is not defeated. AB 155 remains alive and able to be heard in the Senate Local <br />Government Committee. Assembly Member Mendoza last July did not opt to request a vote on <br />his measure, knowing that it lacked sufficient votes to move out of the Senate Local Govemment <br />Committee. Since then, however, the composition of the committee's has been altered in a <br />manner which could be more favorable to AB 155's passage. <br /> <br />City officials should be aware that municipal bankruptcy issues could still emerge in a different <br />legislative vehicle than those listed above. <br /> <br />The League will continue to monitor both bills and any other legislation that attempts to address <br />municipal bankruptcy.
