<br />Additional requirements may be added at an agency's discretion. A <br />sample form is included as Exhibit A to this Agreement. <br /> <br />When a person with access to WBISS is no longer employed or <br />no longer accessing WBISS on behalf of the Member Agency, the <br />~iihle for removing all related passwords and security <br />authorizations from the system. <br /> <br />No person with access to WBISS shall release any information <br />or records located in WBISS except to the extent required by law. <br /> <br />4.3.3 Insurance: Each Member Agency, at its sole cost and expense, <br />shall carry insurance -or self-insure - its activities in <br />connection with this MOU, and obtain, keep in force and <br />maintain, insurance or equivalent programs of self-insurance, <br />for general liability, workers compensation, and business <br />automobile liability adequate to cover its potential liabilities <br />hereunder. <br />4.4 Connecting \vith other COPLINK Nodes: The Board of Police <br />Chiefs and Sheriffs will continually work to expand the connectivity <br />of the WBISS West Bay Region Node and will actively pursue <br />opportunities to alnend this MOU to include other COPLINK nodes <br />under the guidelines outlined in this agreelnent. <br /> <br />5 Information Ownership, Release and Accuracy <br /> <br />5.1 Ownership and Release Constraints: Melnber Agencies shall retain <br />control of and relnain the official custodian of all infonnation they <br />contribute to the West Bay Region Node. To the extent permitted <br />by law, requests for information under the California Public <br />Records Act or Freedom of Information Act, will be directed back <br />to the Member Agency that is the owner of the requested data, and <br />will be responded to accordingly. <br /> <br />5.2 Information Utilization: Any Data present in the COPLINK system <br />is the proprietary information of the Member Agency contributing <br />that Data. Each Member Agency has an affirmative obligation to <br />assure that all Data complies with 28 CFR Part 23. 28 CFR Part 23 <br />is attached herein as Exhibit C. Member Agencies and authorized <br />users may use the Data for Law Enforcement use only. The Member <br />Agency responsible for contributing the Data shall have sole <br />discretion regarding release of that information. <br /> <br />5.3 Information Accuracy: Member Agencies and authorized <br />users acknowledge that Data maintained in the West Bay Region <br />Node consists of information that mayor may not be accurate.
