<br />8.2 Lessee's Duties. Lessee shall hire an adequate number of persons in order to <br />provide food services in a prompt and timely manner under this Lease. <br /> <br />8.3 Payment of Lessee's Emplovees. Lessee shall pay all persons hired as required <br />by law, including but not limited to, income tax withholding and social security <br />payments. No employee of Lessee shall be deemed to be an employee of <br />Lessor. <br /> <br />8.4 Qualitv of Food. All food and presentation shall be first class with the minimum <br />standard being high quality food and service comparable to or exceeding those <br />of other similar businesses. The highest standard of cleanliness and sanitation <br />on the premises and in the course of food preparation shall be maintained <br />without exception. <br /> <br />8.5 Manaaement of the Concession Space. Lessee shall manage Froyola, LLC and <br />all operations therein. <br /> <br />8.6 Hours of Operation. Lessee shall be open for business and conduct full scale <br />operation hereof no later than 11 :00 am and close no earlier than 7 pm, <br />everyday. On recognized Federal holidays only, Lessee may close or be open <br />for a reduced number of hours, and shall post a sign to show the change in hours <br />in advance of the holiday. <br /> <br />8.7 Material Waste Reduction. Lessee shall reduce, reuse, and recycle materials in <br />order to reduce the amount of waste sent to landfills. Lessee shall participate in <br />the County of San Mateo's composting collection program as feasibly possible. <br />Biodegradable products are encouraged. Styrofoam "to go" containers are not <br />permitted. <br /> <br />8.8 Alcohol. Lessor will allow for the sale of only beer and wine if Lessee obtains the <br />required permits from the California Department of Alcoholic Beverage Control. <br />Lessee shall serve beer and wine in a container that identifies the beverage as <br />purchased from the Lesee. The serving of beer and wine in bottles, boxes, and <br />cans are not allowed. <br /> <br />8.9 Eauipment Maintenance. Lessee shall clean all equipment daily and perform <br />routine maintenance upon all equipment. <br /> <br />8.10 Custodial Services. Lessee will provide all custodial services and day-to-day <br />clean-up for the Lease Area. <br /> <br />9 USE AND TIME OF USE <br />9.1 Unless otherwise agreed to by Lessor in writing, the Premises may be used only <br />by Lessee and Lessee's agents, customers, and contractors for the purposes <br />stated herein. <br /> <br />9.2 Lessee agrees not to use or permit use of the Premises for any unlawful <br />purpose, and not to commit or permit any waste or nuisance in or about the <br />Premises.
