6.1 C <br /> Pa e 1 <br /> RE'P�RT <br /> To the Honorable Mayor and City Council <br /> From the City Attorney <br /> March 22,2010 <br /> Subject <br /> Approvai of Form to Claim Exemption from Transient�ccupancy Tax <br /> Recommendation <br /> Approve,by motion,attached Exemption Form. <br /> Background <br /> Reven�e and Taxation Code Section 7280 s#ates that the legislative body shall adopt a <br /> form that is to be used by the hotel operator wher�a federal,state,or foreign employee on <br /> afficial business claims an exemption from the payment of transient occupancy tax. In <br /> order to claim the exemption the employee has to provide�hota identifica�ion along with <br /> one of the following three items: travel orders; a government warrant #o pay for the <br /> occupancy;or a government credit card. <br /> The Council may be surprised that the approval of this form requires its action,given that <br /> the form seems to be merely a detai!of tax implementa#ion. It would seem more likely that <br /> the form could be done by anyone in�he City who is responsible for the tax ca(lection. I <br /> can only tell you that the Legislature sometimes,and maybe frequently,works in ways that <br /> we do not understand.
