ORIGINAL <br /> AMENDMENT NO. 1 TO LEASE AGREEMENT <br /> WITH STEVE PENNA AND REGINA VAN BRUNT <br /> FOR LEASE AREA 2B AT 2210 BROADWAY <br /> THIS AMENDMENT NO. 1 is entered into as of , 2011, amending the lease <br /> agreement dated March 24, 2010 (the "Original Lease greement") by and between the <br /> Redevelopment Agency of the City of Redwood City, a public body, corporate and politic, duly <br /> organized and existing under the laws of the State of California ( "Agency" or "Lessor "), and <br /> Steve Penna and Regina Van Brunt, individuals doing business as "Some Stuff on the Square ", <br /> hereinafter referred to as "Lessee ", (collectively the "Parties "). <br /> RECITALS <br /> WHEREAS, the Lessees proposes to close Some Stuff on the Square during the months <br /> of January and February 2011 due to the winter months; and <br /> WHEREAS, the Lessees request that the rent for January and February 2011 be waived; <br /> and <br /> WHEREAS, the Parties have negotiated and agreed to the following amendments to the <br /> Original Lease Agreement. <br /> NOW THEREFORE, in consideration of these recitals and the mutual covenants <br /> contained herein, the Parties agree as follows: <br /> 1. Paragraph 3.1 is hereby amended to read as follows: <br /> "Lease Payment. The monthly rent to be paid to the Lessor shall be $100.00. <br /> Lessee shall pay to Lessor the monthly rent in advance, on or before the first day of each <br /> and every month of the Lease Term beginning on April 1, 2010. Lease payment for any period <br /> during the term hereof which is for less than one month shall be a pro rata portion of the monthly <br /> installment. <br /> Commencing January 1, 2011 and thereafter, the monthly rent for January and February <br /> shall be waived." <br /> 2. Paragraph 8.6 is hereby amended to read as follows: <br /> "Hours of Operation. As a short-term Lessee, Lessee may elect to close its operations <br /> during the months of January and February as well as Federal recognized holidays commencing <br /> January 1, 2011. Otherwise, Lessee shall be open Tuesday through Friday, 11:00 AM to 3:00 <br /> PM. <br /> Lessee may be open during special events." <br /> 3. All other provisions of the Agreement, as may have been amended from time to time, will <br /> Atty /Agr /2011 /Amend /Some Stuff on the Square Amend #1 <br /> 010611 1 <br />
